THE jury is considering its verdict in the case of a restaurant worker accused of raping a 19 year old female customer in the toilets of the Spice House Indian restaurant in Stroud.
Jurors retired to begin deliberating on the case of Mohammed Iqbal Hussain on Wednesday and continued throughout Thursday.
Hussain, aged 21, of Blundell Road, Sparkhill, Birmingham, who worked as a delivery driver for the restaurant in Gloucester Street, Stroud, denies raping the woman on September 14 last year.
The prosecution say he raped the girl, who already knew him, after he texted her in the restaurant and asked to meet her for a chat in the ladies loos.
But in evidence, he told the jury she had sex with him willingly,.
"She went into the toilet and I followed her in," he said. "I locked the door behind me so we would not be disturbed.
"I made the first move and we both kissed. There was no reluctance from her. She didn't push me away and we kissed on the mouths.
He said he proceeded to have sex with her then left the toilet without any further conversation.
She went back to the table where she was having a meal with a friend, he said.
Later, when she texted him saying 'Why would you do that to me'.
Hussain said he did not have a clue what she meant.
The case continues.
