A PIZZA chef who twice raped a woman he lured home by playing the Good Samaritan has failed to get his convictions overturned on appeal.

Kawan Deylan raped the mother, in her 40s and from Stroud, after she missed her last train home from Swindon.

Deylan had offered the woman a bed for the night.

Although he admitted having sex he claimed it was consensual.

Deylan, aged 32, of Rodbourne Road, Swindon, was jailed for six years after being convicted of two counts of rape at Swindon Crown Court last year.

But lon June15, he asked the Appeal Court in London to overturn his convictions.

The court heard Deylan took advantage of the woman who was stranded at Swindon station after missing her connection, and was stuck with no train until the morning and not enough cash to get a cab.

Police went to Pizza Express, in Old Town, Swindon, where Deylan worked to speak with him after his victim complained she had been raped in the morning.

Deylan complained that his barrister at trial had ignored his pleas to cross-examine his flatmate further in the hope that some evidence would arise to back up his claims.

Lord Justice Toulson said barristers are not obliged to asked questions they think are inappropriate just because they are urged to do so by their clients.

"This is a hopeless submission," he said.

"Counsel defending in criminal cases who ask stray questions in the hope that they will get an answer of some benefit run the real risk that they may get the reverse."
